Royalhost.com.pk – Hosting Service Terms of Service

1. Definitions

  • “Company” refers to Royalhost.com.pk.
  • “Client” or “User” means any individual or organization that purchases services from the Company.
  • “Services” include, but are not limited to, web hosting, server space, domain registration, email hosting, and related offerings.
  • “Content” means all files, data, audio, video, images, text, databases, and software uploaded by the User into their account.

2. Formation of Agreement

This Agreement shall commence when the User places an order, makes payment, and accepts these Terms of Service. The subscription period and applicable payment terms shall be specified in the invoice or order confirmation.

3. Scope of Services

  • The Company shall provide hosting services for the agreed subscription period.
  • Uptime guarantees and maintenance schedules (if any) will be clearly stated.
  • The scope of customer support, including availability (e.g., 24/7) and response times, will be specified.

4. Payment Terms

  • The User is responsible for all applicable charges, including renewals and taxes (e.g., sales tax, GST, or other applicable duties).
  • Payments must be made in accordance with the billing schedule. Late payments may result in suspension or termination of services.
  • Refunds, if applicable, shall be subject to the Company’s refund and cancellation policy.

5. Acceptable Use and Prohibited Activities

The User shall not use the Services for:

  • Hosting or distributing illegal content or infringing copyrighted material.
  • Spreading malware, spam, phishing, or conducting hacking attempts.
  • Pornographic, blasphemous, or otherwise prohibited content under the laws of Pakistan.
  • Any activity in violation of the Prevention of Electronic Crimes Act (PECA) 2016 or other applicable Pakistani laws.

6. Data Protection and Privacy

  • The Company shall take reasonable measures to protect User data.
  • Use of personal data, retention periods, and backup policies are outlined in the Privacy Policy.
  • In the event of a data breach, the Company shall notify Users as required by law.

7. Intellectual Property Rights

  • The User retains all intellectual property rights to their Content.
  • The Company is granted a non-exclusive right to store, transmit, and manage such Content solely for the purpose of providing the Services.
  • The User warrants that their Content does not infringe on any third-party intellectual property rights.

8. Limitation of Liability

  • The Company’s liability is limited to direct damages only, and excludes indirect, consequential, or incidental damages.
  • Exceptions may apply in cases of gross negligence or willful misconduct.

9. Suspension and Termination

  • The Company may suspend or terminate Services in cases of non-payment, illegal use, misuse, or violation of these Terms.
  • Upon termination, the User shall be provided a reasonable period to retrieve their data, after which the Company reserves the right to delete such data.

10. Governing Law and Dispute Resolution

  • These Terms shall be governed by the laws of Pakistan.
  • Jurisdiction shall rest with the courts of Karachi, Sindh (unless otherwise specified).
  • Alternative dispute resolution methods, such as mediation or arbitration, may be used where agreed by both parties.

11. Changes to Terms

  • The Company reserves the right to update or amend these Terms at any time.
  • Users will be notified of such changes via email or website publication.
  • Continued use of the Services after such changes shall constitute acceptance of the revised Terms.

12. Miscellaneous

  • Force Majeure: The Company shall not be liable for delays or failures caused by events beyond its reasonable control (e.g., natural disasters, government actions).
  • Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • Assignment: The Company may assign its rights or obligations under this Agreement to a third party, subject to applicable law.
